Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Renter," "you," or "your") and LakeDay Kelowna Boat Rentals Inc, operating in Kelowna, British Columbia ("Company," "we," "our," or "us"). By accessing our website, creating an account, making a reservation, or using any of our boat rental services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our services.

1. Eligibility Requirements

To rent a vessel from LakeDay Kelowna Boat Rentals Inc, you must satisfy all of the following requirements: you must be at least nineteen (19) years of age, which is the age of majority in British Columbia; you must possess a valid Pleasure Craft Operator Card (PCOC) as mandated by the Canada Shipping Act and Transport Canada regulations; you must present valid government-issued photo identification at the time of vessel pickup; and you must have a valid credit card in your name for the security deposit authorization.

By completing a reservation, you represent and warrant that you possess the requisite knowledge, skill, and experience to safely operate the rented vessel in accordance with all applicable federal, provincial, and municipal laws and regulations. If you do not currently hold a PCOC, you may obtain one through a Transport Canada-accredited course provider prior to your rental date. Failure to present a valid PCOC at the time of pickup will result in cancellation of your reservation, and standard cancellation fees will apply.

2. Age Restriction

Our boat rental services, website, and SMS/text messaging programs are intended solely for individuals who are at least eighteen (18) years of age or older. By using our services, creating an account, making a reservation, or opting in to receive text messages, you represent and warrant that you are at least eighteen (18) years of age. If you are under the age of eighteen (18), you are prohibited from using our services, providing any personal information to us, or consenting to receive SMS communications.

While the legal age to operate a motorized vessel in British Columbia is nineteen (19) years of age, we require all users of our digital services and SMS programs to be at least eighteen (18) years of age to comply with telecommunications regulations and consent requirements. Individuals under nineteen (19) may browse our website for informational purposes but may not complete a reservation or rental transaction.

We reserve the right to verify your age at any time and may request government-issued identification to confirm compliance with this age restriction. If we discover that a person under eighteen (18) has provided personal information or opted in to SMS communications, we will promptly delete such information and terminate any associated account or consent.

3. Reservations and Booking

Reservations may be made through our website or by contacting us directly by phone or email. A reservation is not confirmed until you have received a written booking confirmation from us via email. All reservations are subject to vessel availability and our acceptance. We reserve the right to decline any reservation at our sole discretion.

Our rental season operates from April 15 through October 31 of each calendar year. Rental durations and time slots are specified at the time of booking and are subject to availability. Multi-day bookings may be eligible for a discount as indicated during the booking process. Overnight rentals are not permitted unless specifically arranged and confirmed in writing in advance.

4. Pricing, Payment, and Fees

Full payment of the rental fee is required at the time of booking and is processed securely through Stripe, Inc., our third-party payment processor. All prices are quoted in Canadian dollars (CAD). Applicable taxes, including Goods and Services Tax (GST) and Provincial Sales Tax (PST), are calculated separately and added to the rental fee at checkout.

Fuel costs are not included in the base rental price and are calculated separately based on actual usage during your rental period. You are responsible for returning the vessel with the fuel level at or above the level indicated at the start of your rental. If the vessel is returned with a lower fuel level, a refueling surcharge will be applied to your account. Additional charges may apply for optional equipment, extended rental periods, late returns, or services requested during your rental.

Promotional codes and discount offers are subject to their specific terms and conditions, may not be combined with other offers, and may be withdrawn at any time without prior notice.

5. Cancellation and Refund Policy

We understand that plans can change. Our cancellation policy is structured as follows:

48+ Hours Before Rental: Cancellations made forty-eight (48) hours or more before the scheduled rental start time will receive a full refund of the rental fee.

24 to 48 Hours Before Rental: Cancellations made between twenty-four (24) and forty-eight (48) hours before the scheduled rental start time will receive a fifty percent (50%) refund of the rental fee.

Less Than 24 Hours Before Rental: Cancellations made less than twenty-four (24) hours before the scheduled rental start time are non-refundable.

No-Show: Failure to arrive at the designated pickup location within thirty (30) minutes of the scheduled start time without prior notice will be treated as a no-show and is non-refundable.

In the event of unsafe weather conditions, dangerous water conditions, or other circumstances beyond our reasonable control that make it inadvisable to proceed with the rental, we reserve the right to cancel or reschedule your booking. In such cases, you will receive a full refund or the option to reschedule at no additional charge, at your preference. We will make every reasonable effort to notify you of weather-related cancellations as early as possible.

6. Security Deposit

A security deposit authorization will be placed on your credit card at the time of vessel pickup. The deposit amount varies by vessel type and rental duration and will be communicated to you at the time of booking. The security deposit hold will be released within three (3) to seven (7) business days following the satisfactory return of the vessel, subject to a post-rental inspection.

You are financially responsible for any damage to the vessel, its equipment, or accessories that occurs during your rental period, whether caused by negligence, misuse, or accident. The cost of repairs, replacement parts, or professional cleaning necessitated by your use will be deducted from your security deposit. If the cost of damages exceeds the security deposit amount, you agree to pay the remaining balance within fourteen (14) calendar days of receiving an itemized damage assessment from us.

7. Rental Period and Late Returns

Your rental period begins and ends at the times specified in your booking confirmation. You are required to return the vessel to the agreed-upon pickup and return location at or before the scheduled return time. Late returns will incur an additional charge of one hundred dollars ($100.00 CAD) per hour or any portion thereof, and may adversely affect subsequent reservations for other customers.

If you anticipate that you will be unable to return the vessel on time, you must contact us immediately at (587) 930-6691. While we will make reasonable efforts to accommodate late returns, we cannot guarantee availability beyond your confirmed rental period. Unreturned vessels may be reported to local authorities.

8. Safety Orientation and Operation

Prior to departure, you will receive a comprehensive safety orientation conducted by our staff. This orientation covers the operation of the specific vessel, the location and proper use of all safety equipment, emergency procedures, local navigation rules and restricted areas on Okanagan Lake, and any vessel-specific considerations. You must not depart until the orientation is complete and you have confirmed your understanding of all safety procedures.

At all times during the rental period, you must operate the vessel in a safe, prudent, and responsible manner in compliance with the Canada Shipping Act, the Small Vessel Regulations, the Collision Regulations, and all applicable British Columbia and municipal bylaws. You must observe all posted speed limits, no-wake zones, and restricted areas. You must maintain a proper lookout at all times and operate at a safe speed appropriate to the conditions.

9. Passenger Safety Requirements

The maximum passenger capacity for each vessel is clearly posted and must not be exceeded under any circumstances. All passengers must have access to a properly fitted, Transport Canada-approved personal flotation device (PFD) or life jacket at all times while on board. Children under the age of twelve (12) and all persons being towed must wear a PFD at all times. It is the Renter's responsibility to ensure that all passengers are aware of and comply with all safety requirements.

10. Prohibited Activities

The following activities are strictly prohibited during the rental period and constitute a material breach of these Terms:

Impaired Operation: Operating the vessel while under the influence of alcohol, cannabis, or any other intoxicating substance. The legal blood alcohol concentration limit for vessel operators in British Columbia is 0.08%, and impaired operation is a criminal offence under the Criminal Code of Canada.

Reckless Operation: Operating the vessel in a careless, reckless, or negligent manner, including excessive speed in congested areas, wake jumping, or operating in restricted or prohibited zones.

Unauthorized Use: Allowing any person other than the designated Renter to operate the vessel, or using the vessel for any commercial purpose, sublease, or unauthorized activity.

Exceeding Capacity: Towing more persons or equipment than the manufacturer's recommended capacity, or exceeding the posted passenger limit.

Tampering: Removing, disabling, or tampering with any safety equipment, navigation lights, or vessel components.

Other Prohibitions: Glass containers are not permitted on any vessel. Smoking and vaping are prohibited on all vessels. Pets may be permitted with prior written approval and an additional cleaning deposit.

Violation of any of the above prohibitions may result in immediate termination of your rental without refund, forfeiture of your security deposit, and liability for any resulting damages or penalties.

11. Vessel Condition and Mechanical Issues

All vessels are inspected and maintained in accordance with manufacturer specifications and Transport Canada requirements. Prior to departure, you will conduct a joint inspection of the vessel with our staff and acknowledge its condition by signing the rental agreement. Any pre-existing damage, scratches, or wear will be documented at that time. You are encouraged to take photographs of the vessel's condition before departure for your own records.

In the event of any mechanical failure, equipment malfunction, or safety concern during your rental, you must cease operation immediately and contact us at (587) 930-6691 for instructions. Do not attempt to repair the vessel or its equipment yourself. We will make reasonable efforts to provide on-water assistance, arrange a tow, or provide a replacement vessel if one is available. If a mechanical issue attributable to normal wear prevents you from completing your rental, we will issue a pro-rated refund or credit for the unused portion of your rental period.

12. Insurance and Liability

All vessels operated by LakeDay Kelowna Boat Rentals Inc are covered by commercial marine liability insurance in accordance with Transport Canada requirements and British Columbia regulations. This coverage protects the company's interests and provides liability protection for operations conducted in the ordinary course of business.

Renters are responsible for any damage to the rented vessel caused by negligence, misuse, or breach of these Terms, as well as for their own personal property. We recommend that you review your personal insurance policies prior to your rental to understand your coverage for recreational boating activities. If you have questions about insurance coverage, please consult with your insurance provider or contact us for clarification.

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless LakeDay Kelowna Boat Rentals Inc, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the vessel, your breach of these Terms, your violation of any applicable law or regulation, or any injury or damage caused to any third party during your rental period.

13. Assumption of Risk and Waiver

Recreational boating involves inherent and significant risks, including but not limited to the risk of drowning, hypothermia, collision, capsizing, personal injury, property damage, and exposure to adverse weather and water conditions. By renting a vessel from us, you acknowledge that you are voluntarily assuming all risks associated with boating activities, whether known or unknown, foreseeable or unforeseeable.

To the maximum extent permitted by the laws of British Columbia, you waive any and all claims against LakeDay Kelowna Boat Rentals Inc for any loss, injury, or damage arising from your participation in boating activities, except where such loss, injury, or damage is caused by our gross negligence or willful misconduct. You further agree that this waiver extends to your heirs, executors, administrators, and assigns.

We make no warranties or representations, express or implied, regarding weather conditions, water conditions, water temperature, the presence of other vessels or watercraft, or the suitability of the vessel for any particular purpose. You are solely responsible for monitoring weather forecasts and water conditions before and during your rental and for making prudent decisions regarding the safety of your outing.

14. Personal Belongings

You are solely responsible for the security and safekeeping of your personal belongings during the rental period. LakeDay Kelowna Boat Rentals Inc assumes no responsibility or liability for any personal property that is lost, stolen, damaged, or destroyed while on board the vessel or at the pickup location, including but not limited to mobile phones, cameras, wallets, jewelry, sunglasses, and other valuables. We strongly recommend the use of waterproof cases and dry bags for all electronics and valuables.

15. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, photographs, audio clips, video clips, and software, is the property of LakeDay Kelowna Boat Rentals Inc or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from our website without our prior written consent.

16. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall LakeDay Kelowna Boat Rentals Inc, its owners, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, personal injury, or property damage, arising out of or in connection with your use of our services, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of our services shall not exceed the total amount you paid to us for the specific rental giving rise to the claim.

17. SMS/Text Messaging Terms

LakeDay Kelowna Boat Rentals Inc offers SMS/text messaging services to communicate with customers regarding booking confirmations, appointment reminders, promotional offers, and other service-related information. By providing your mobile phone number and expressly consenting to receive text messages from us (either through our website contact form, booking process, or other opt-in mechanisms), you agree to receive automated and non-automated text messages at the phone number you provide.

Consent and Opt-In

Your consent to receive text messages is not a condition of purchasing any goods or services from LakeDay Kelowna Boat Rentals Inc. You may opt in to receive two categories of text messages: (1) transactional or non-marketing messages, including booking confirmations, appointment reminders, cancellation notices, safety alerts, and customer service communications; and (2) marketing or promotional messages, including special offers, discounts, seasonal promotions, and general marketing content. You may consent to one or both categories independently.

By opting in, you certify that you are the authorized user of the mobile phone number you provide, or that you have obtained authorization from the account holder to receive text messages at that number. You agree to notify us immediately if you change your mobile phone number or if you are no longer the authorized user of the number you provided.

Message Frequency and Content

The frequency of text messages will vary depending on your interactions with us and the categories to which you have opted in. Transactional messages are sent as needed in connection with your bookings and account activity. Marketing messages may be sent up to four (4) times per month during peak season (April through October) and up to two (2) times per month during off-season (November through March). We reserve the right to adjust message frequency based on operational needs, special promotions, or urgent communications.

Message and Data Rates

Standard message and data rates may apply to all text messages sent and received in connection with our SMS services, as determined by your mobile carrier. These charges are your sole responsibility. We do not charge any fees for our SMS services, but you are responsible for all charges imposed by your mobile carrier. Message and data rates vary by carrier and plan. Please contact your mobile carrier for details regarding your specific plan and any applicable charges.

Opt-Out and Help

You may opt out of receiving text messages from us at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any text message you receive from us. After you opt out, you will receive one final confirmation message acknowledging your opt-out request. Following your opt-out, you will no longer receive text messages from the category you opted out of, unless you opt in again or as required by law. Opting out of marketing messages will not affect transactional messages related to your active bookings.

Supported Carriers and Delivery

Our SMS services are available to users on participating Canadian mobile carriers, including but not limited to Rogers, Bell, Telus, Freedom Mobile, Fido, Koodo, Virgin Plus, and Chatr. We cannot guarantee message delivery to all carriers or in all geographic areas. Message delivery may be delayed or prevented by factors outside our control, including network congestion, carrier technical issues, device compatibility, or your device settings.

Privacy and Data Use

Your mobile phone number and SMS consent preferences are collected, used, and stored in accordance with our Privacy Policy and applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti-Spam Legislation (CASL). We do not sell, rent, or share your mobile phone number with third parties for their own marketing purposes. We may share your information with our SMS service providers solely for the purpose of delivering text messages on our behalf.

Compliance and Liability

Our SMS program complies with the Telephone Consumer Protection Act (TCPA) in the United States, Canada's Anti-Spam Legislation (CASL), and the Canadian Radio-television and Telecommunications Commission (CRTC) regulations. We do not guarantee the security, confidentiality, or timeliness of text messages. You acknowledge that text messages may be intercepted, delayed, or lost due to factors beyond our control.

We are not liable for any damages, claims, or losses arising from your use of our SMS services, including but not limited to charges imposed by your mobile carrier, unauthorized access to your device, or any reliance you place on information received via text message. You agree to indemnify and hold us harmless from any claims arising from your provision of an incorrect phone number or your failure to notify us of changes to your phone number.

18. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) calendar days, either party may submit the dispute to mediation administered by a mutually agreed-upon mediator in Kelowna, British Columbia. If mediation is unsuccessful, either party may pursue resolution through the courts of competent jurisdiction in British Columbia.

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the courts of British Columbia for the resolution of any dispute arising under or in connection with these Terms.

20. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such finding shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

21. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms agreed upon at the time of rental (including the physical rental agreement signed at pickup), constitute the entire agreement between you and LakeDay Kelowna Boat Rentals Inc with respect to the subject matter hereof and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and us regarding the services.

22. Modifications to These Terms

We reserve the right to modify or update these Terms at any time by posting the revised version on our website with an updated "Last Updated" date. Material changes will be communicated through a prominent notice on our website or by email to registered users. Your continued use of our services following the posting of revised Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.
